Terms & Conditions

1. General 

1.1
These Terms and Conditions (T&Cs) constitute an agreement between the Participant and Ljus Studio-Carla Araos Yoga, and all teachers at Ljus Studio (collectively referred to as “Ljus Studio”). By participating in any classes, events, workshops, retreats, or other services offered by Ljus Studio, the Participant agrees to be bound by these Terms and Conditions, which govern their participation and use of the services provided. The customer confirms that they have read these Terms and Conditions (available at https://ljus-studio.com/legal-notice/) and have given their consent.

1.2
Any subsequent changes or additions to these Terms and Conditions will be published on the Ljus Studio Zürich website. These changes will become part of the agreement unless the participant objects to the updated T&Cs within 30 days of becoming aware of them.

2. Scope of services

2.1
The services include the implementation and organisation of yoga classes, workshops, retreats, birth preparation, studio rental as well as non-mentioned contracts that are related to the business activities mentioned.

2.2 
The current schedule of classes/workshops/retreats and special events can be found at www.ljus-studio.com / https://www.eversports.ch/widget/w/bguhpM and are subject to change without prior notification. Participants that have a class reservation will be informed of any changes to the schedule that directly affect their class booking. Ljus Studio reserves the right to modify, suspend, or discontinue any service at its discretion, with or without notice, based on operational needs.

2.3
Ljus Studio shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to natural disasters, strikes, pandemics, or governmental restrictions

2.4
The events listed on Eversports that are not directly bookable through the platform are independent events organised by third parties. These events are listed for marketing purposes only and must be booked directly with the event organisers. Each of these events is subject to its own set of terms and conditions, which can be obtained by contacting the respective event organisers directly.

2.5
The studio will open fifteen minutes before the scheduled class start time. Students are advised to arrive within this time frame. The opening times stated on Google Maps are based on the current schedule, but may not reflect short-term changes or cancellations.

3. Costs, prices and terms of payment

3.1
The current costs for yoga classes, workshops and special events can be found at www.ljus-studio.com

3.2
Full payment for yoga classes/passes is made before the class begins. Unless otherwise agreed or specified, payment is made before the class/first day of the event via Eversport GmbH online via https://www.eversports.ch/widget/w/bguhpM.

4. Terms and conditions of reservations and cancellations

4.1 Passes
The yoga passes expire after their validity date, are personal and non-transferable. The yoga passes are valid from the date of purchase.
Paid service fees for passes will not be refunded. In the event of illness or an accident, the duration of all passes can be paused accordingly, upon presentation of a doctor’s certificate. Changes in the schedule or in the teacher can be made at any time. There is no entitlement to a refund if a class is taught by a substitute teacher.

4.2 Reservation regulations
Online reservation is mandatory for all classes at Ljus Studio via Eversport GmbH at https://www.eversports.ch/widget/w/bguhpM. Ljus Studio cannot guarantee free spots in the scheduled classes if attended without prior reservation. If the class is full, the student will be placed on a waiting list. The booking through the waiting list is binding and the cancellation policy stated below is applicable.

4.3 Cancellation by participants
The cancellation conditions are outlined in the Registration Email (Booking Confirmation) sent via Eversports GmbH. These conditions are also available under the booking details on the Eversports checkout page. The cancellation terms are specific to each class/event, and it is the sole responsibility of the participant to review the cancellation policy for the class/event they are attending.

All cancellations must be made through the online reservation system (website or app) provided by Eversports GmbH. Cancellations made by phone, WhatsApp, Instagram, or email will not be accepted.

In the event of a late cancellation (outside of the specified cancellation window) or a no-show, the class/event will be deducted from the participant’s subscription without further notice. For classes/events paid for individually, the paid amount will not be refunded. Classes/events with pending payments must be paid in full.

4.4 Cancellation by Ljus Studio / change of teacher
In the event of illness or unforeseen circumstances, Ljus Studio reserves the right to cancel a yoga class/event, even at short notice, or to arrange for a qualified substitute teacher. Participants will be informed of any cancellation or teacher change as soon as possible via email, SMS, or telephone, except in cases of unforeseeable cancellations.

4.5 Cancellation and minimum number of participants for group classes
Group yoga classes are subject to a minimum number of participants. If the minimum number of participants is not met, the class will be cancelled. In such cases, the paid amount can be used as credit for an alternative class at Ljus Studio, but no refunds will be issued. For classes reserved with a pass, the pass will not be deducted.

In the event that a class is canceled due to insufficient participants, all registered participants will receive an automatic cancellation email. This email will be sent at the end of the cancellation period, based on the cancellation policy. For example:

  • If the cancellation policy allows participants to cancel up to 2 hours before the class starts, the cancellation email will be sent 2 hours prior to the class if the minimum number of participants is not met.
  • If the cancellation policy allows participants to cancel up to 12 hours before the class starts, the cancellation email will be sent 12 hours prior to the class if the minimum number of participants is not met.

4.6 Cancellation and minimum number of participants for Special Classes, Workshops, Retreats, and Events
For special classes, workshops, retreats, and events, if the minimum number of participants is not met, the cancellation policy will follow the same terms that apply when a participant cancels, unless otherwise stated in the specific cancellation conditions for that event. If a special event or workshop is cancelled due to insufficient participants, all participants will receive an automatic cancellation email sent in accordance with the end of the cancellation period.

4.7 Cancellation of classes and opening times
If a scheduled class or event cannot take place, Ljus Studio may remain closed for the duration of the class or event. The online opening times of the studio in this instance are no longer applicable.

4.8 Cancellation policy for Private classes and Private Birth Preparation Courses
Appointments for private classes or private birth preparation courses must be cancelled or rescheduled more than 24 hours before the agreed appointment time. Cancellations made less than 24 hours before the start of the class or course will incur the full class/course fee, and no refund will be provided.

5. Eligibility / Liability

5.1 Eligibility
Participants must complete an online registration form prior to participating in yoga lessons. The registration form includes these Terms and Conditions, which must be reviewed and accepted by the participant. By completing the registration form and accepting these Terms and Conditions, the participant confirms that they have no health concerns preventing their participation in yoga courses, events, or workshops. Participation in all courses is at the participant’s own risk and responsibility. In the case of acute physical or psychological issues, participants are advised to consult with a doctor before participating in any courses, events, or workshops to ensure that yoga is safe for them. Yoga classes may have an impact on physical, mental, and psychological well-being. It is important to note that yoga classes do not serve as medical or psychotherapeutic treatments.

In addition to completing the online registration, all participants—whether they have booked online or not—must fill in and sign a sign-in sheet before taking part in any classes, events, workshops, or retreats. Participants cannot take part without completing this sign-in document.

Existing mental or physical health restrictions, as well as any existing pregnancy, must be reported to the teachers at Ljus Studio no later than at the beginning of the event.

Participants must adhere to any protective measures (e.g., COVID-19 regulations) introduced by the federal government, canton, or Ljus Studio. Failure to comply with these measures will result in the participant being unable to participate in the yoga classes, workshops, and events. In such cases, a refund of the paid fee will not be provided.

5.2 Punctuality and Conduct
Participants agree to arrive on time for all classes and events at Ljus Studio. Participants must also handle the studio space and its props with due care and respect. They must not disrupt the class or interfere with the experience of other attendees.

5.3 Right to Refuse Access and Terminate Services
Ljus Studio reserves the right to refuse a participant’s access to the studio and to suspend or terminate the use of services provided by Ljus Studio if, in the reasonable opinion of the studio, the participant’s conduct is damaging to the studio’s reputation, breaches these Terms and Conditions, involves threatening or abusive behaviour, or is otherwise deemed detrimental to the interests of other users of the studio, participants in classes, or the teachers of the studio.

6. Liability

6.1
Ljus Studio accepts liability for the proper execution of courses, events, and workshops in accordance with statutory warranty provisions. Any further liability, including for damages, is expressly excluded. Specifically, Ljus Studio does not assume any liability in cases where physical or mental health conditions have been concealed by the participant, which could make participation in yoga events or workshops inadvisable.

Ljus Studio reserves the right to refuse participation if it is determined that the participant does not meet the health or psychological requirements for the class. This refusal may occur at short notice or even during an ongoing class. In such cases, the participant will receive a pro-rata refund for the class fee.

6.2
The use of the course premises and services is at the participant’s own risk. Ljus Studio accepts no liability for any valuables brought by participants. Ljus Studio is also not liable for any injuries or incidents that may occur on the premises, except in cases of gross negligence or intentional misconduct.

6.3
For all yoga classes and events organized by Ljus Studio, Ljus Studio excludes any liability for damages incurred. Participants are responsible for ensuring they have sufficient insurance coverage (e.g., accident, theft, loss of personal items, etc.). Ljus Studio cannot be held liable for the theft or loss of any items.

7. Prices 

7.1
All prices are listed in Swiss Francs (CHF). Prices are subject to change, and Ljus Studio reserves the right to correct any errors or misapprehensions in pricing. The prices applied at the time of the order will be considered binding.

8. Data protection

8.1
Protecting your privacy is important to us. Ljus Studio is committed to handling personal data confidentially and will not share it with third parties, except when necessary for organizational purposes (e.g., sharing with teachers or business partners). Ljus Studio will use the personal data collected to communicate regarding class schedules, bookings, and promotions. Participants can opt out of marketing communications at any time by unsubscribing from emails or contacting the studio directly. Participants also agree to maintain the confidentiality of information regarding other course participants.

9. Copyright

9.1
The copyright and all other intellectual property rights to the content, images, photos, videos, and other materials on the Ljus Studio website and other media are the exclusive property of the provider. Reproduction, distribution, or use of these materials is prohibited without prior written consent from the copyright holders. Any violations will be subject to legal action and may result in the obligation to pay damages.
